These terms and conditions (“Conditions”) are the terms on which cash4metal (“C4M”) purchases Goods from customers (“Customer”). These Conditions apply to the exclusion of any other terms the Customer may seek to impose.
1. Definitions
1.1 “Goods” means gold, silver, platinum and other precious metals including jewellery, coins and bars.
1.2 “Customer” means any person or entity offering Goods for sale.
1.3 “Business Day” means any day other than weekends or public holidays in England.
1.4 “Offer” means the price offered by C4M following inspection.
1.5 “Inspection Location” means the premises where Goods are received and assessed.
2. Basis of Transaction
2.1 Submission of Goods constitutes an offer by the Customer to sell.
2.2 No contract exists until C4M issues acceptance.
2.3 C4M may refuse any transaction at its sole discretion.
2.4 C4M shall have no obligation to provide a reason for refusal.
3. Mail-In Service
3.1 C4M operates strictly as a mail-in service only.
3.2 Goods must be sent using Royal Mail Special Delivery only.
3.3 Any other delivery method is entirely at the Customer’s risk.
3.4 C4M reserves the right to reject deliveries sent incorrectly.
4. Metal Calculator and Indicative Pricing
4.1 Any calculator, estimate or pricing tool provided by cash4metal is for convenience only.
4.2 Any value generated:
- (a) is an estimate only;
- (b) is based on Customer input;
- (c) depends on accuracy of that input;
- (d) reflects market price at time of use only;
- (e) may differ at time of receipt.
4.3 Metal prices fluctuate and may change between calculation and receipt.
4.4 Calculator values do not constitute an offer.
4.5 No binding price exists until formal Offer is issued.
4.6 C4M may disregard calculator values entirely.
5. Transit Risk and Insurance
5.1 C4M accepts no liability for loss, damage, delay or deterioration in transit.
5.2 Risk remains with the Customer until Goods are received.
5.3 Goods sent via Royal Mail Special Delivery are insured subject to compensation limits, currently capped at £2,500 per parcel.
5.4 The Customer is responsible for ensuring value does not exceed this limit.
5.5 Claims must be made directly with Royal Mail.
5.6 C4M shall have no liability whatsoever in respect of transit issues.
6. Inspection and Testing of Goods
6.1 C4M shall inspect all Goods upon receipt.
6.2 C4M may reject Goods which:
- (a) are not precious metals;
- (b) are not as described;
- (c) have no commercial value.
6.3 Returned Goods may incur postage and handling charges.
6.4 C4M may dispose of Goods of no value.
6.5 C4M may test Goods including:
- (a) acid testing;
- (b) cutting or filing;
- (c) XRF testing.
6.6 Testing may cause damage or alteration.
6.7 The Customer accepts this risk.
6.8 C4M has no liability for damage caused by testing.
7. Valuation
7.1 Price is determined at C4M’s sole and absolute discretion.
7.2 Factors may include:
- (a) weight;
- (b) purity;
- (c) condition;
- (d) market price;
- (e) any other factor deemed relevant.
7.3 Prices fluctuate and are not guaranteed.
7.4 No obligation exists to match other offers.
7.5 No obligation exists to explain valuation.
8. Non-Precious Materials and Components
8.1 C4M does not purchase gemstones or non-metal components.
8.2 C4M may:
- (a) remove;
- (b) destroy;
- (c) retain such components.
8.3 No liability exists for loss of such items.
8.4 Non-precious items may incur testing or handling fees.
9. Offers and Validity
9.1 Offers are valid for 24 hours unless stated otherwise.
9.2 C4M may:
- (a) withdraw offers;
- (b) revise offers;
- (c) treat offers as expired.
9.3 Delays may result in revised pricing.
9.4 Acceptance creates a binding contract.
9.5 Once accepted, Goods may be melted and cannot be returned.
10. Payment
10.1 Payment shall be made via bank transfer.
10.2 C4M may:
- (a) delay payment;
- (b) refuse payment methods;
- (c) apply fees.
10.3 Payment is typically within 1–2 Business Days but not guaranteed.
10.4 Incorrect bank details are Customer responsibility.
11. Identification and Compliance
11.1 Transactions over £5,000 require identification.
11.2 Required ID may include:
- (a) passport or driving license;
- (b) proof of address.
11.3 C4M may:
- (a) delay payment;
- (b) refuse transactions;
- (c) report activity.
11.4 No liability for delays caused by compliance checks.
12. Returns and Charges
12.1 Returned Goods will be sent via Special Delivery.
12.2 C4M may charge:
- (a) postage;
- (b) handling;
- (c) insurance.
12.3 Goods may be split into multiple parcels.
12.4 Charges may be deducted from payments.
13. Storage and Disposal
13.1 C4M may charge storage fees.
13.2 Unclaimed Goods may be:
- (a) returned;
- (b) disposed of.
13.3 Disposal may occur without notice.
14. Overpayment
14.1 Any overpayment must be repaid within 48 hours.
14.2 C4M may recover funds by any lawful means.
15. Fraud and Ownership
15.1 The Customer warrants legal ownership.
15.2 C4M may:
- (a) refuse transactions;
- (b) retain Goods;
- (c) report to authorities.
16. Liability
16.1 Liability is limited to value at receipt.
16.2 No liability for indirect or consequential loss.
17. General
17.1 C4M may amend these Conditions at any time.
17.2 Failure to enforce rights does not waive them.
17.3 These Conditions form the entire agreement.
18. Governing Law
These Conditions are governed by the laws of England and Wales.
